If the router supports Tomato/DDWRT it may be worth moving to that? Though I guess you don't want to knacker your warranty. You can probably re-flash the original firmware though.
Tbh you have a case for demanding a refund as it isn't fit for purpose. I'm not 100% sure of the legalities though.
