For Info or For those that might see the same issue,
A simple rebuild of a new motherboard, memory and nvme's took a little longer than normal.
Asus ROG Hero Z790
i7 13700KF
No overclock just memory on XMP 1 profile
DDR5 Kingston 6400 Fury Renegade 2x matched pairs Kingston 2x16 x2 total 64Gb all 4 were the same week
Normally I would place 1st matched pair in slots A1 B1 and 2nd matched pair in A2 B2 however this caused Bios Memtest 86 & Windows 10 memcheck to show test fail
All 4 singles tested OK and passed, Both pairs tested OK and passed, but with the 4 combined the same test failed.
Changing the pairs so that each matched pair was in A1,A2 anbd B1,B2 fixed the memory test errors.
Just incase anyone else has this issue try using pairs in the same bank, pair 1 in bank 1(A) and pair 2 in bank 2(B)
