Maximum Frequency Question!

I have a i5 2500k @4.4Ghz is it normal in resource monitor after just booting for the maximum frequency to go over 100%? It goes to like 120-130% then drops to around 48% plus when doing nothing on the desktop.

The stock frequency is 3.3GHz and your overclock is 130% over stock roughly. Then when the OS is fully loaded and the system idles, it will reduce the frequency to 50% until you start an application that requires the clock speed. Try and see what it does if you run something like prime95. As far as I'm aware this is perfectly normal.
