Mediation and stuff

Hi all

Just wondering if anyone knows much about child custody and stuff.

I seem to of got a grasp of the whole process but would like to bypass official mediation as there is an amicable agreement already made, however we would prefer to set this in stone in court.

Apparently the court can send you to mediation but when I looked into it you can sign a form to show that you don't need mediation as both parties basically have nothing to argue about.

Does anyone know if the court would bypass mediation on still make a court order or would they just decide as it is amicable then they don't need to make a court order?

Our solicitor said there is no point paying her huge fees for a court order as she won't actually do anything bar fill out forms and introduce us to the court something that we can do very easily ourselves, but she did suggest the mediation route, this confuses me so as said is there anyone who's been down this road that could state whether or not we need mediation.

What your solicitor has said sounds right, I'm sure if you really did need her, she'd accept and charge you her fees?

There's nothing for the solicitor to argue about, so the court is just there to "finalise" the agreement.
 
Cheers kylew, it's sort of the way I saw it, no arguments so need to mediate or get lawyers involved, I just dont want the courts dismissing it due to us being amicable.
