I know what your saying but understand the a OS aint a software you install like a program e.g MS Word. Vista out of the box works on my system but i had to do windows update every works fine except there is no drivers for my PCI 56k modem which i installed incase my net was ever down.

its the hardware manufecture's that need to provide the drivers/software for the OS.

No it says in the eula that if you do not agree to it you will be given a full refund. It would be illegal otherwise.

How does one do this exactly? Perhaps we could use Microsoft Vista readiness tool? It checks your system for incompatible programs and hardware. All my hardware checked out fine (as in a previous post) but I have had 497 and counting problems to report in week, and large numbers of BSOD on session after session. Perhaps the new Nvidia drivers will sort this issue, will try tonight.

Wrong. You accept the license when you break the seal. If you want to think otherwise then fine but Gibbo himself has said that OcUK or any other store for that matter will not refund it if the seal has been broken.

yeah you pay your money you take your chance ,but as long as your board and CPU is top draw you should be ok .. ;)

but would the retailer give you that refund? not a chance, as for MS then if you could prove or they could check the key has not been used then, yes, they do similar things with online games...
 
Highly doubt they will give you a refund. It was obvious it was not going to be perfect on release and opening the case means you could have copied down the license and copied the disc. (assuming there is a way around the copy protection).

Most retailers would just turn you away even if the law says different. If the law is on your side then you could always just take it futher.

Firstly, this is not legally enforceable in the UK. You need to be able to read the EULA before accepting the agreement.

Secondly, the system builder can't accept the EULA for his/her customer, therefore the system builder can only accept the system builder licence (which is supposed to be supplied on a sheet of paper with every OEM copy)

You are supposed to be able to get a refund if you don't get further then the EULA acceptance, although it's not as easy as that in reality.

Just because a retailer may refuse to give a refund, it doesn't mean that they are correct in law to do so. How they re-sell it afterwards is their problem, not the consumer's.
 
The only way to read the EULA is to buy the product and open the box. If you then don't agree with the EULA and don't install the product, you are entitled to a refund.
 
Strikes me that a lot of people have dodgy, unstable hardware and they're just using the fact that they've bought Vista to whinge.

Yeah definately. My vista is 100% stable. I haven't had one lockup/crash or program error from using it. I think people should check their hardware and also install Vista on a clean HD.

Makes a world of difference.

I've had it since Beta2. Used the RC too. Now i'm waiting on delivery of the finished product tomorrow.

Only the Beta2 was x86 for me, my current install is/was x64. It's running superbly, at least as fast as XP, and that's with beta drivers.

I say "is/was" as i've formatted ready for retail tomorrow.

Without sounding patronising I think some people should look inside their cases before they blame the product. Especially as many have it working flawlessly.
