Moral conundrum please help

Then you tell the seller the item is waiting for them to collect, and keep all records of communication. You don't go ahead and open it/use it.
 
This is one of those "if you have to ask, you already know the answer" type questions.

If OP's conscience was totally clear, he wouldn't have made the thread.

yep, I concur. I think OP knows what to do, really, however..

If you feel like you deserve some sort of 'moral revenge' for being messed around with a long dispatch time, just tell them a convenient time for them to collect from you is 6pm on a Sunday or something.

Keeping items that don't belong to you isn't on though.

This sounds like a reasonable compromise tbh!
 
And for how long for? The point I'm making is, it will eventually get to a point where something needs to happen to the item whether you keep it, sell it, bin it, or send it back at a cost to yourself. If the seller is not interested in paying to return the item, then it's stuck with you, but as there hasn't actually been a sale, it's still being classed as theft.

Edit: I'm not agreeing with the OP's choices here, I'm just pointing out that "theft" isn't as black and white as people are making it out to be.
 
If I felt messed around by the seller I certainly wouldn't be going out of my way to do them any favours.

I'd go by this idea, send them an email saying an item has arrived and they should send for a collection at a specified time that is suitable for you.

If the seller makes it obvious he or she doesn't care/want the item, then it's not theft.
 
To set the record straight I've done the morally *correct* thing. No matter how much it pained me to. Ironically still awaiting the response.

As for whomever said I was a hyperactive kid or whatever chasing and sending loads of emails. I placed an order and waited a week and the item hadn't been dispatched, their excuse was a "warehouse delay" and would send the next day. A week after that with 3 emails spaced apart the seller finally responded that they would be sending an item that was DIFFERENT TO THAT DESCRIBED (foreign spec unit not UK like advertised).

I don't feel that was particularly out of the question as the delivery estimate was 2-3 days.......

Either way, I can appreciate people saying I'm thieving etc etc, I think when I made the thread I was more amazed at having received it and wanted some conversation about it.

I don't use ebay a lot and never been in this situation but what if you send the item back and it goes missing or gets back to them damaged. Are you responsible, can they make a claim against you, thus making you run around after RM etc? Genuine question as I'd be paranoid that they'd be underhand enough to try it on.
