MOT Fail?

My sister has asked me to take her car for an MOT and it expires on the 14th, since we are away from the 5th to the 12th I have had to book it for the 14th.

Now I have had a check of her tyres and they have maybe 2-2.5mm tread depth so I was going to advise her to replace them fairly sharpish, but I have also just noticed a gash in one of them.

Now she is going to definatly get these changed when we get back, but will it go through an MOT like this as we don't have time to get the tyres changed before the 14th?

Thought it was accross the middle 75% for tread? Its above the rubber markers that are in the main tyre tread.

Its a council station so they do nothing except test. I am worried they might say its unroadworthy and I can't drive it, so I'll have to find time to get some new rubber.
