My Ipod has been lost in the post, where do I stand ?

Right, well a long story shortened but my Ipod has been playing up recently, I've got 3 years extended warranty on it, expecting it to be replaced. but when I took it back to where I got it from (which is where I work, I work for a big retail out let, which is a sister company of the pink shirt shop)

Anyway I take my faulty Ipod home, and make a call to the relevant department, and get told it's going to be collected from my home. Fine, I'm then told a company called Equinox something or other are going to call me the following day, I'm not at work that day, I'm home all day, so no worries. I get no phone call.

A few days later no phone call, so I wait one more day, and I get a package in the post, with pre-paid postage (four first class stamps) I post it off in the packaging they sent out to me on the 22nd of may, I don't hear anything till yesterday at work on my mobile from them asking if I've sent it. I say yes and they say, oh we haven't got it.

Now this is the provblem, the postage wasn't insured, with hindsight I should have paid extra and had it insured (rmsd) but all I have is a postage certificate that only covers me upto £35 or so. It was first class postage aswell.

Basically where do I stand and whose responsibility is this ??

i have to say as a sales person I'm shocked at the service I've had (although to be fair I don't know why I was expecting it to be any different)
 
Normally I'd say you're stuffed for not sending it recorded signed for (or infact special del for an iPod), but the interesting point here is that the company sent the packaging so I can't imagine they can argue that *you* didn't post it properly since you just did what you were implicitly told.

Although it is a good point that they provided the packaging however you dont have any proof of delivery. The fault clearly doesn't lie with the mail even though they lost it, they only cover to £35 under this type of postage, what have the company said?

Personally, id stop any communication with the company, contact trading standards (I believe they have local 'call centres' called consumer advice centres) who will be able to help you organise writing a suitable letter, send it recorded delivery and go from there.
 
I'm just a bit gutted to be honest, I wouldn't have cared if it was small 20 gig HDD, but the fact is, it's my Ipod (only a mini, but cost me a lot of money)

My Dad reckons that the people who sent me the packaging are responsible for it as they did not provide any kind of insurance and that my 3 years cover in actual fact should sort it out.

I sort do have a card I could play that means being every so slightly dishonest, wait for 28 days and then say to the warranty people that the ipod was never collected, but the people they use for repairs has it on record that 1) I sent it off 2) they haven't got it, andI sure as heck haven't got it.

Bloomin royal mail.

Think that it might well be worth a trip to CAB ??

All they have said is "We haven't got it, have you sent it yet ?" When I said yes and said that I had proof of posting the girl on the end of the phone (who I have to say has been very helpful) said "Well it must be lost in the psot then, just report it to the post office you sent it from" Thats pretty much all they said, it's as if the onus is on me to prove that I sent it, part of me is thinking that some guy at the repair company has swiped it :(
 
The best you may get out of this is your £35 cover.

The company nor the P.O. is going to except direct responsibility for it.

If I get the time I will do on Tuesday, thats the trouble at the moment is that my days off aren't till next Friday/Saturday :( The longer it goes on, the moreI feel it will never be sorted.
 
They provided you with the packaging so they are responsible for it. They purchased the stamps so they are bound to the Terms and Conditions that Royal Mail govern themselves by.

So the company can claim the £35 pounds from Royal Mail and the company should foot the bill for a new Ipod for you.

You didn't buy the stamps so it has nothing to do with you.
 
Hmmm well with no proof of postage or extra insurance on the mailing side you don't have much to fall back on I'm afraid.
In hindsight it should have been sent registered.

All is not lost though. If you were so inclined you *could* check your home insurance contents policy. You might well be (I know I am because this happened to me) covered for losing your ipod when you were out and about in town.

If for example you went shopping, had the ipod in your pocket and fear that it fell out of your pocket and became lost you might well be covered for a brand spanking new one.

Now if that is not what happened then you're making a fraudulent claim.

You could tell the house insurance that you sent it in the post, however that probably means you aren't covered. You could phone them up for a quote and just say that you want to check the policy covers you for things sent in the post. There are lots of things you could do....
 
They sent you the packaging to use for their RMA process so its THEIR problem to sort out NOT yours.. contact trading standards and the Citizens advice.

You used the packaging THEY stipulated so you have followed their RMA process to the letter. Not your problem.... persue this all the way.

If you had packaged it up yourself and decided on the postage method then yes it would be your tuff luck but this is not the case is it?

They will argue that it is not their fault that it was lost in the post. They will argue that he needs to take it up with Royal mail. They will also probably have something in the small print about insurance through the post being his responsibility.

Who said I'd never 'heard of it' before?

I just don't like it. It's the type of phrase used by people who think they can speak English but can't.
