National Minimum Wage

I've just noticed that the national minimum wage (NMW) has increased to £6.08 for over 21s but my wage hasn't increased yet (I'm paid weekly).

When does your employer have to change your wages to fall in-line with the current NMW?
 
I have no legal information but i would guess asap as it is law that this is the minimum employers should pay. They are not saying to employers, oh it would be nice if you could try and meet these recommendations when you get a chance. They are saying, this is by law the minimum you will pay your employees and now!

From the 1st of October. So if you are paid weekly in arrears then you should see an increase next week.
 
Speaking about the NMW, what re your thoughts about people not paying it?

I know someone who works in a cafe and is paid £5ph, cash in hand. Now, I understand the benefit of being paid cash in hand but I think that this is wrong.

My friend doesn't want to bring it up because the employer is a family friend, she reckons shell have to pay tax (though she'd still be better off after tax on 6.08ph and the fear of being sacked.

If it was me, I'd be speaking to the boss straightaway and threatening some sort of action (though what that would be I do not know....)

Thoughts, OcUK?

Surely shes not over 21 on that wage?

I don't think you have a leg to stand on what your hourly rate is when your being paid cash in hand :p
 
You pay next to no tax on NMW anyway, and presumably she's entitled to tax credits etc.?

For a 40 hour week she would be £187.50 a month (on average) better off in terms of income, less tax that would be £107/month more overall (not accounting for NI or tax credits).

Based on a 40hr week (which she is very unlikely doing with a cash in hand job) she would only be £10.79 / week better off on NMW and paying tax..

But I guess since she is "unemployed" she may be claiming benefits while working cash in hand anyway?
 
She isn't claiming anything, and has a proper (as in tax & NI paying) part time job.
I hadn't run the sums to see how better off she'd be. I just think people should be paid a correct wage, and the NMW is the least an employer should be doing.

Well, then it depends on how many hours/how much she earns in the part time job, but if she uses up most of her personal allowance on the p/t one then she is far better off on £5 cash in hand than NMW and on the books.

And I will reiterate, if you want to engage in illegal activity, you can hardly complain that the other person isn't sticking to the law either. ;)
