Need advice regarding a loan

I'll try to keep this short as to not bore you. About a year ago my sisters ex boyfriend who was living with us signed up for Littlewoods in my name and bought a £300 bike. He told me it'd be fine and that he'd pay it back no problem. As I'm sure you can guess, he still hasn't paid it back. I've been getting letters froms Lowell debt collectors since, and more recently letters from Hampton Legal which is Lowell's legal department I think.

The letter says if I don't pay they can apply for a county court judgement and have bailiffs to remove goods from my home. Or instead of CCJ, I can apply for bankrupcy.

My question is, how serious are these claims? I'm not going to pay this loan because it's not mine, and I can't afford to anyway. I've been on the phone to Lowell multiple times and they told me I could file for fraud against my friend, but I don't really want to do that either. My "friend" keeps telling me that £300 is too low of an amount of money for them to do anything, but I don't trust this guy at all anymore.

Any advice at all would be appreciated.

It was quite silly of you in the first place to let him do it in your name. Just pay the £300. If you get a CCJ or default your credit rating will be rock bottom for 6 years and you will barely be able to get a bank account or mobile phone.

I've just finished uni and am unemployed. I can't afford £300.

In my experience £300 is not to low of an amount and they will chase you for it.
Plush the fees for the companies used to collect the debt.
Bailiffs are usually a last resort tho.
If you ring them up sometimes they will cancell the debt if you pay a % of the total owed as a lump sum but not always.
Or They should give you the option to pay monthly but will usually want the full amount if doing this.

As the debt is in your name then I think they are right you ether have to pay or file for fraud.

Why don't you want to get him done for fraud?

If he's letting you take the fall for this he's hardly a friend, so tell him to pay it or face the consequences.

You do realise, this has probably messed up your credit rating a fair amount, thus removing any chance of you having any sort of finance in a good few years to come?

Call him up, tell him he's got a week to pay because you're getting grief about it. Otherwise you call the police..

No 'friend' would do this.

I'd lend money to a friend, but this is taking the monkey

How serious is getting him done for fraud? How much trouble would he get in?

I didn't know he used my name until the bike arrived.

Then it's clear cut fraud, if he cant or wont pay it back then it's his problem. Report him.

He's lying about the amount not being worth them chasing. I've had debt collecters chase me for less.

As bledd. says, tell him he has one week to pay up or you'll go to the police. And actually go to the police.

Did you actually sign the agreement with littlewoods? If you didnt you need to say to the guuy "oi ****wad gimme the money" + whatever interest they are now looking for, or you will report him to police.
Sad but true, leechers like this are scum.

My sister ran up a couple of grand debt on my house, then left the country. I never had a single person call at the door. Many many letters and threats, i called a few of them up and gave them her address and phone number in spain, never heard from them again.

Yeah, I know. But I had no reason to not trust him. Him and my sister have a son. He was living with us for 2 years and we were good friends for that time.

He signed up on the littlewoods site with my name.

agreed, you should allow NO ONE to get credit on your back.

Indeed, and it won't be happening again I assure you.

You MUST deal with this because it IS serious. This is trashing your credit rating and it will only get worse if they apply for a County Court Judgement. Once a CCJ has been granted the Court can and will appoint baliffs to recover property.

He's not a friend, he deliberatley dropped you in the crap by taking out a loan he had no intention of paying off.

Ide file for fraud & have a damn good look at your credit rating to find out what else he's being doing in your name. ;)
