New console:old HDD...okay for XBLive?

Hi everyone....

My son's got a 2nd hand XBox360 that's banned off XBL - it was fine for a few weeks but one day he couldn't get on and found it had been banned cos it had been 'modded'.

If I was to get another unmodded & unbanned console - they're on that auction site, bare bones - no cables, hard drives etc.... - could he.....

1) Disconnect the bad one and hook up the new one and play XBL again and pick up from where he left off with all his gamer scores etc by putting the existing HDD into the new one (or is it the hard disk that's banned and as soon as he connects to XBL it'll re-boot him off again??)

2) What's involved in taking the drive out of the old one and putting it into the new console...? Is it just a case of pulling the drive out and inserting into the new console or is there a need for tools etc...(as you can guess...I'm NOT a gamer :D:D)

2 is easy to answer - it simply pulls out and slots back in to another console. No problems there.

1 is less easy to answer. I've always assumed that it's the console that's banned from Live. I know it's certainly not the account. However, I've no idea whether that banning is tied into the hard drive in any way and whether the ban will transfer over if you transfer the hard drive as well. Sorry for the lack of a clear answer, it's not something I've seen anyone try before.
 
Davey is right. The console is banned and NOT the Profile/Hard drive. It's like an Olive branch from MS, we will ban your console, however you can buy another 360 and come back using your original profile :)
 
I would guess they probably ban the MAC address of the network port, or maybe details like serial number taken from the motherboard.
It is the same way Punkbuster uses GUIDs (code assembled from MAC, M/B serial number etc) to ban on PC.
