New fence, Neighbour Problem.......

Back garden has a party fence running between me and the neighbor. At the moment its 4ft, however i want 6ft 6" (legal limit) as its more privacy.

They have declined my offer to replace the old fence with the new one as they said it will block out the light to the garden :confused: (I'm paying for it all), i said we either move the old or i run on my land.
Answer i got was "put it on your own land then)

I have been very polite thought the process.

Any tips or advice, it gets fitted soon. I will be running on my own land alongside the old fence (will look terrible their side which is something they are finding had for them to grasp). I think its now come down to being stubborn over the benefits of a new fence, the old is nackard..

I was told if we put the fence up they will destroy it. Any advice???

Are you paying for their sunlight?

And just because the old one is knackered doesn't justify building a markedly higher fence.
 
Our fences are about 4 foot, I can see why your neighbours objected as they quite big and look a bit ugly. I feel we get enough privacy but then again we get on with our neighbours...

But it's your land at the end of the day :)
 
I would investigate if it actually does block out their light then ask the council about it, as sometimes the council have a right to take down a wall or fence built.
 
Would the high wall look out of place with other properties? Need pics to decide.


Also, why did the fence go to the disco???

What they willdo is pull the old fence down, and have a nice new looking fence without paying for it, and more land.

Who owns the land the original fence is on? Check your boundaries.
 
Thorper?! Confusing or what! I'm going to look at your posts and wonder why they don't include a pic of yourself for about 6 months, guaranteed.

They will destroy the new one or the old one? If they destroy the new one it's criminal damage.

That said I'd forget the idea of a 6' fence (do you REALLY need the extra privacy?) and go halves on a nice new 4 footer.
 
I think they're well within their rights to refuse it. If it's a party fence then they have a say in how high, what kind of fence etc, regardless of who's paying for it. Put it up on your own land if you want a higher fence and leave the old one up on the party line.

Also make sure you put the fence the 'right' way around. I'm sure the common law is that whoever sees the back of the fence(the supporting ribs) and not the 'nice' side is the owner of that fence.
 
Just plant some fast growing trees or bushes. Will have the added benefit of hiding your fence as well.
 
WTF do you need a 6ft fence for? I had the conversation with both neighbours either side of me when we moved into a new build.. I flatly refused on the grounds that we don't live in boxes and there's nothing that makes anyone different from anyone else, we all live, eat, sleep , breathe, wear underwear (probbaly put in on the washing line as well).

Anyway since the 4ft went up we've had many good chats and the kids have shouted over and played over fence which we couldn't have done with a 6ft.
 
Who owns the fence? It is likely to be either yours or their property but is unlikely to belong to both.

You've asked nicely and he/she has expressed a preference that you don't replace it with anything higher. You've been reasonable in asking but they have been reasonable in expressing their preference. If the fence is actually your property then they can't stop you putting it up. Or if it's not your property you are still entitled to put up your own fence on your own property. If it is on your property they are not allowed to damage it and you could sue for repair costs. I suspect what they will do is wait for you to put yours up then they will remove the old one. They sudden;y gain a few inches of garden. While those inches won't actually belong to them it will be harder to prove in the future.

So are you willing to give up a few inches of garden, and also significantly degrade your relationship with your neighbour, over wanting a slightly higher fence?
 
Maybe the op takes part in back door antics in his yard? :p

yeah this is done for security with closed board fencing, even with normal 6ft pannels most have an obvious outside/inside design
