New Holiday Entitlement

Hi Folks,

I am leaving my current job on the 13th of April, obviously my Holiday resets 1st of April. I really have 2 questions.

1) Is it 1 month I have to work of the year to be entitled to my full holiday either as being off or getting it paid?

2) I currently have about 10 days still left to use this year, do I use these instead of asking for my full entitlement for next year in pay?
 
You're basically asking us to guess the contents of your contract. Holiday entitlement can vary wildly from company to company and in effect only you can answer your own question.

As a wild, and highly inaccurate guess I'd say that you will get a 1/24th of your holiday entitlement for working half of April and you'll only be able to carry over between 3 and 5 days from this year's entitlement.

But as I said, check your contract. Or speak with HR.

Holiday pay has a legal minimum.
Assuming the legal minimum

You have a legal right to your holiday pay you have accrued, pro rata.
Say 24 days per year, and you work just 3 weeks of the new holiday year, you'd earn..

(24 / 52) * 3 = 1.38 days holiday.

to assume you'd get your entire year's holiday allowance after working just one month is silly. Or silly in 99.999999% of companies.

Be warned, if you're on a legal minimum amount (24 days) then it's illegal now to roll over holidays, though many places turn a blind eye. New law also states you can't get paid for it, you HAVE to take off the minimum time.

Of course, if you get more than 24 days and you've had 24 days, you can get paid for the extra.
 
Oh my god. I haven't read any of the above I've had such a sudden rush of excitement.

If I get this job I'm interviewing for, can I just take my months notice off as I currently have 34 stored days holiday (some taken over from last year)?

No, you have to work the whole year to be entitled to all of your holiday. Or you would working for my company anyway.

I don't understand why you believe you're entitled to next years holiday days without working the year.
 
Girl that worked for my folks did this, her leave year was Jan-Dec, she had 3 weeks hols booked end of Jan and handed her notice in the day before (or something along those lines) saying that she'd use her holiday for her notice period.

My folks sent a letter to say sorry it's worked out at x days per month so technically you owe us money. But they just agreed to not pay her the comission owed and leave it be (this was less than what she'd owe them).
