new ipod used??

Quick question

Just got a green nano for the missus. The case looked like it was opened. Went to charge it for first time, message on i-tunes came up "this ipod has been synced with another library do you want to erase and sync with current" etc

free space 3.68 gigs. There are no 'songs' on the thing, but was wondering if the capacity should be higher or is this normal?
