New job and tax question.

I know this has been asked before many times but I'm having trouble understanding it all. I used to work for McDonalds :o and left the end of September. I started my new job the second week in October. Its been over a month now and I still have not had my P45 from McDonalds. I've just had my first pay slip from my new job and I'm on the tax code BR. I was previously on 522L and I told this to my new employer.
So what I'm asking is, what should I do and how long does it take to get my tax back that I'm owed?
 
Fill in a p46 and send it to current employers payroll takes about 2 weeks to go through does the same job as a p45

Not sure on time question though
 
Wrong, generally any overpayments of tax are refunded in the next pay run.

If its discovered in the current tax year, that is.

spot on - if McD send you the P45 and your new employer uses the code on the next available payrun then you should get a refund or at least pay a lot less tax in that month.

where it could get sticky is if McD send it with M1 or X after the code.

so long as your payslips were as 522L then it shouldn't be an issue.

I would call their payroll section and ask to speak to the head of the dept.
explain your missing P45 and how much you are being crippled by tax in your new job.

while you are on the phone confirm you home address - often P45's go to the last known address (hopefully your payslip will show the current correct address).

in the short term a P46 from your new employer will at least allow them to use the 522L code even if it's on the M1 basis until your proper P45 arrives.
it'll be a heck of lot less tax :)
