Er no - if they intended to prosecute they would have issued a ticket there and then. The point of an NIP ("Notice of Intended Prosecution") is that it is issued where the driver was not stopped, and asks the driver to admit that they were driving at the time of the alleged offence. It would be very silly to stop a car, establish who the driver was, but not issue a ticket if they wanted to prosecute.
