Doesn't really make any difference if the RK is on a provisional, though one thing worth investigating would be how any points acquired roll over onto a full licence, especially given the 6 points in 2 years after passing your test = you are a learner again situation.
The worst case scenario would be 6 points for failing to identify the driver = the moment you pass your test you're instantly back to a provisional as they carry over. But I honestly don't know if this is what will happen.
You get 28 days to reply, so if you do the "out of time" thing (and be sure to keep a copy of the original NIP, actually you should probably return the copy) they should reply to you explaining why they're not out of time and the RK can then reply normally.
