No insruance and stopped !

I have a friend who stopped his car insurance direct debits as he was going on holiday and need the cash (daft I know).

As I paid the deposit for his insurance as a favour they deducted the missing payments from my card. After I found out I complained to the company (and my friend) and have since been re-imbursed by the company.

Thing is his insurance is now void as he has not made the payments and as sod's law goes he was stopped randomly the other night. He insisted he was covered and showed the police his cover note that was issued at the time of purchase and they said fair enough they will look into it as their system said the car was un-insured.

I reckon he has been a complete idiot but he thinks he'll get away with it. I do know that if they indeed check and even though he takes out insurace now will the car still get taken and crushed. Also is he likely to get banned/points etc?
 
Well, he won't get away with it that's pretty much certain. Point and a fine are also pretty much certainties. Ban is possible but depends what the magistrate decides.
 
If the car is going to be taken, it would be taken there and then at the roadside, if it is not collected within x time with valid particulars, it's outta there.

Your "friend" will almost certainly be awarded 6 points & ban/fine.
 
You see this all the time on police shows, someone will take out a policy, get all the documents and then cancel it but they still have what looks like a valid certificate if they ever get pulled over. It doesn't work though as the police just check with the insurer resulting in points and a fine.
 
I was stopped and given a random producer years ago, and was uninsured on the vehicle in question at the time. The desk clerk asked if I was involved in any sort of RTA and I replied that it was just a spot check - so he let me go with no more said.

I was absolutely bricking it at the time.

I know that the 'friend' issue is usually a way of avoiding saying it is yourself you are talking about but believe me it is someone else.

I just dont understand why he has been so daft. He reckons that because they did not take the car there and then he is in the clear. He also confessed he has done it all his drving life. In a small way I kinda hope he does lose it as it might give him a kick up the jacksy about the way he does things but then he is my mate. :rolleyes:
 
LOL, he's boned, but he won't loose his car, he'll just have to sell it because:
A) He has a fine to pay.
B) He won't have a licence for a while and won't need it.
 
the next step would presumably be for the officer who pulled him to ring the insurance company.

They would then tell him he cancelled his DD and isnt insured. And receive a summons through the post and get into lots of dodo at court

why didnt the copper ring the insurance at the roadside however ? they do on roadwars / traffic cops etc.. as they say its a common ruse. Take out insurance, get covernote, cancel DD and use covernote to blag police

sounds like the copper wanted an easy life. sods law says he got pulled by the only lazy copper who now wont follow up on this :/

I saw a similar situation on Road Wars not so long ago. Apparently its common for people to cancel the DD and hang onto the documents to try and fob off the police if they get stopped. But in the days of ANPR, I dont know why they think they can get away with it. On that episode, they just phoned the company who told the coppers he was uninsured and they dealt with him appropriately.

Daft thing is he was stopped at night and they said "the car is uninsured" he insisted he was and had claimed the polcie followed him home to view the Certificate and they said "our database is telling them the vehicle is uninsured" but they would look into it.

As MrLoL said, he is prob just lucky that get got pulled over by a lazy copper !

I'ts only been a week I'll follow up on future events. (Bound to be better than the plot line on EastEnders ! :) )

Or the officer didn't want to put his job on the line and do something which could land him with a complaint.

The police national computer is not 100% accurate. The only way the officer could confirm whether he was insured or not, despite what the PNC tells him is by contacting the Motor Insurance Bureau, police officers cannot call the insurance companies themselves to ask if the person is insured, as the insurance company will not disclose that to the officer due to the data protection act. The officer must make contact with the MIB who will make that enquiry with the insurance company, who will then get back to the officer, so that he can then make an informed decision.

The MIB is not open at night, leaving the officer unable to take action at the scene. He may choose to follow up the enquiry and pay your friend a visit later though to issue him with a penalty, but this probably won't happen as the officer probably has more things on his plate.
