Oblivion..changing refresh rates

How do I change the refresh rate playing Oblivion. I'm currently playing on a TFT @60hz but the game seems to default to 75hz which causes the game to constantly stutter. When it stutters I don't mean frame rate stutter or hard drive activity but a constant juddering. I know this because I have a fps counter in the top right corner by bringing the console down and typing: setdebugtext 12, then type tdt on the next line, this gives you the fps counter it anyone wants to know. It's at a constant 75fps but it still judders like it's not in sync with the refresh rate and I have vsync on.

When I whack my monitor up to 75hz then it's fine but I have to force it in the nvidia control panel. I don't really want to do this as it may damage my monitor. Is there a console or ini tweak to set the max refresh or max fps?

This maybe just my system but has anyone else suffered from this?

The game runs fine otherwise.
