Onboard LAN loses static IP on reboot

Got a bit of a weird problem, mobo is a P965-DS3P, since the last few days the onboard NIC loses it's static IP address and tries to get 1 via DHCP. If I then go into the LANs properties and give it the same IP address as before it then tells me it's already in use and that if I really want to use it I should hit No and reboot. If I do this then the PC boots up fine with the address I want but after a cold I have to do the above all over.

I've had a look in the BIOS but can't see anything, I've deleted the NIC from device manager and I've got the latest drivers from Marvell but nadda.

Anybody have any words of wisdom?
 
When it boots and has lost the static IP, if it won't accept the static IP you are trying to use try running:

ipconfig -all

in a DOS (cmd) window, that should tell you if it has assigned that IP to another 'adaptor'.

IP Config /All shows nothing cause the only active LAN card is trying to get a lease which my router won't issue as I've set it up with MAC filtering. The IP address in use message I've tracked down to a device entry in the registry. XP thinks there's a card already using this address.

What I've found is that if I delete these phantom device entries then a reboot later and I'm back to square 1 but if I just leave things as they are it seems to maintain the static IP I've set. Bit illogical but the PCs been switched on and off a few times since and it's been working fine.

I'm also going to try changing out the BIOS battery as the kids mentioned that there was a message along the lines of 'BIOS scan' followed by 'backup neeed' during the DOS boot stage yesterday which is when this problem started.
