Order Cancelled, Still processed payment & sent - where do i stand re. refund?

Morning all and a very happy Christmas eve to you all!

Just a quick question regarding a situation I have found myself in.

I purchased a present for my gf about 3 weeks ago and paid for next day delivery, a week later still had not recieved.

Checked the website and the goods hadn't even been processed.

Contacted the company via email to say I would like to cancel and order elsewhere, which they responded with an appology & said this would be ok.

A week later I get an email to say goods have been dispatched, and with the bad weather has taken even longer to get to me, still not recieved. Since this time I have purchased and recieved goods elsewhere.

Question is...where do I stand regarding getting my money back? I have had an email response saying I need to reject delivery and they will process a refund once the goods are back with them.

My problem is, the goods are coming here at work, on the tracking it is still not out for delivery, I finish today at 12 and not back till January 4th.

What can I do? Goods were purchased on Credit Card if that helps?

If you have a clear record of cancelling the goods in terms of an email acknowledgement or something similar then you are probably fine. Worst case is simply to return in under the disatnce selling regs.

Equally if the delivery company can't deliver the goods they should send them back to the sender.
 
If the company is EU based.
Under DSA you can return any goods bought online, within the first 7 days after their delivery, if they have yet to be delivered then your 7 day timer hasn't started.

Start a paper trial, and record everything, phone/email and physically write to cancel the order, althought only 1 should be necessary.
 
Sounds like they already shipped the goods before you canceled and its been stuck in a backlog.

Even if it goes beyond the distance selling time, a lot of retailers have Xmas returns periods, especially owing to the weather.

i had this problem last year bought some clothes for my niece on 5th december and couldn't take them back until boxing day the shop had in small print 14 day returns policy :( shop in question was H&M

If you had taken them back within the 14 days then they would have refunded you.
What's your problem?
It's not their fault you couldn't return the items in time.
