I woke up at 5am this morning to find a ticket stuck to my window.

£35 (if I pay withing 14 days, otherwise £70) for doing what I have always been told to do by fellow drivers when parking in layby's - to make sure your cab is swing in toward the left to stop the mirror sticking out (and getting ripped off by a passing wandering truck!) also, it greatly reduces the buffeting you get as large vehicles pass during the night.

My "offence" was as follows...

612 A heavy commercial vehicle wholly or partly parked on a footway, verge or land between two carriageways (partly on footway)

My nearside front tyre was resting against (as opposed to on or over) the kerb (due to me turning the cab left as described above) so I guess I'm "bang to rights" in their eyes anyway?

Had I been awake, I'd have been sorely tempted to bang the **** out!

I'm going to appeal, not that I fancy my chances, I did myself no favours by not taking a photo of the position of the tyre against the kerb.

I guess it depends whether they took a photo of you there? Could be a bit hard to at 5am.

The ticket was issues just before 1AM, the road was dark too so I doubt they took a picture.

I intend to lodge an appeal, I'm just wondering if I should pay the reduced fee first and then claim it back if (and thats a big if!) I win my appeal.

Or is paying up effectively admitting guilt?

I'm reluctant to pay, don't get me wrong, the last time I appealed a ticket, I ended up paying the full penalty (£70) as the appeal process took longer than the 14 days grace they give you to pay the reduced fee.
 
Just a shame your handbrake didn't fail as he was sticking the ticket on your window....
 
Can you not set the date/time on your camera back and take a picture? Even if they do have a photo as you've said surely it will just show your wheel resting on the kurb?
 
Park straight in future would be my advice. Never heard of doing what you do and I would just assume it was lazy/bad parking as well. I understand why you did it but....just fold your mirror back and be done with it?
 
can you not ask them for photographic evidence? Surely without it these days it wouldn't stand up in court?
 
If you are genuinely not obstructing the path, then I would say that's sensible, in a layby.
What if you got shunted or had some kind of brake failure? You wouldn't want to be rolling into traffic..

I would certainly consider an appeal, but I would check the actual law first... I would guess if you mounted the kerb then you won't have a leg to stand on, but if you were simply resting against it I can't see it being an issue... surely they will need photographic evidence in this situation?

Mind lorry tyres are quite big, so I would guess what's classed as mounting and what is simply overhanging will be worth looking into, i would guess the center of the wheel would have to be on or over the threshold to be classed as a mount.

Certainly warrants further research...
 
Thats crazy. I see this all the time in Layby's but never seen anyone ticketed for it. Got to be worth appealing :)

As far as i know, if you appeal and its rejected, you still have the same 14 days to pay the reduced ticket.
 
Spoke to the council by phone earlier, they think I have a good case for appeal.

I'll be writing an e-mail to them later tonight, I did check, an appeal holds the 14days grace, so, if I lose the appeal, I can still pay the reduced fee, as long as I pay within 14 days from the date of the result of said appeal.

Not quite the (parking) 3rd Reich thus far....... :D

Have people not heard of a flash before?
not taking a picture because its too dark is a joke, as is not knocking on the window before slapping the ticket on.
 
Surely if the vehicle was causing an obstruction and the driver is asleep in it the logical thing to do would be tap on the window and "Sorry mate, would you mind moving the vehicle? Ta."
Whereas sticking a ticket on the window means that the vehicle stays there continuing to cause an obstruction until the driver wakes up five hours later! How many orphans have been killed in that five hour period!

Unless it's a money making scam and not actually about road safety....
 
No obstruction, (the layby was not even near a pavement!) if the chap had knocked me up and told me to move - he would not have got his "ticket bonus" me thinks...... ;)
 
Meh! Finally gave up (after 5 months of wrangling) & coughed the £35. :(

Miserable gits, at least I fought it! :o :D
 
The fact that it rolled on for five months surely suggests the Council's case was less than convincing...

Please don't tell me you fell for the whole "If we drag it out and fob him off he'll get bored and give in" routine? :(
