Heaven and even 3Dmark can drop the frame rate, that's what they are designed to do 
About the pin situation I don't know really. Intel going 'not my problem if you bend the pins but the motherboard's problem'?
Also, BF3 Beta only runs on high, ultra settings seems to only be a placeholder.
