Paypal - seriously, what?

So I bought an item on Ebay described as 'nearly new'. It's quite a sensitive peice of electronics so I was keen to get one as new as possible.

It turns up and it's actually 9 years old - the production date is clearly stamped on it, and its pretty grubby, as you'd expect from a 9 year old item. The item has a recommended 'life' of 10-15 years.

Seller not interested so I filed a Paypal dispute.

I've just had the dispute ruled in.... the sellers favour. Apparently the item is 'As described'. The decision was made without requesting any photographs of the item, without contacting me and without any contact from the seller whatsoever.

So I called Paypal. The guy on the phone agreed entirely with me, could not understand why it had been ruled against me, but said there was nothing that could be done.

If I had less morals than I do I'd stick it back on Ebay as BRAND NEW and laugh at the buyer :rolleyes:
 
Sounds about right to me. They are absolutely useless. I had a similar thing happen to me, had to go to small claims court in the end.
 
Similar thing happened to me, bought a 'new' ABS sensor for my mondeo as I had broke mine when working on the car.

When I recieved said item it was just the wire and no sensor!

Tried contacting the seller, no luck, opened up a dispute with paypal, the seller responsed to paypal just fine. I lost as he could prove he had sent the item! Rang them to say I had opened the dispute as item not as described & not an item not recieved case, because it had been closed they couldnt override it.

Lost out on a bit of cash...bet the seller got away with a few of these, thought paypal was save...never used paypal since...
 
The guy at Paypal I spoke to was at a loss for words, he could not understand why they had sided with the seller and said if he was looking at the case he would clearly have ruled in my favour. He said though that once the decision is made nothing can be done and suggested I emailed the complaints department..

There's no way "there's nothing that can be done". The seller is has basically comitted fraud. The problem with PayPal is they let the seller counter claim without asking you for more details. You need to try and state all the details pics etc in the first place.

If the seller is an actual business you may have better luck outside of PayPal, but it's just the hassle of it all I suppose. I'd be more concerned of the sellers actions than PayPals as over the counter you'd still be in the same boat without a middle man to complain to.
 
I had a problem recently where I bought a set of 5 intelligent lights that were advertised as DMX. Anyone who have used DMX know that the cables are either 3-pin or 5-pin XLR. Nope. These lights came with 4-pin fittings! Even the pros at my local sound/lighting shop haven't heard of 4-pin XLR, so I filed a Paypal dispute against the seller. After reading these nightmare stories here, I feel myself lucky that Paypal sided with me and I was reimbursed the final bid value. The only thing I lost out on was the £12 courier cost to get the lights back to the seller.

Was it 'a lot' of money?...Not really the point I know but you kinda get what I mean...In a way its their fault and in a way its yours.

Their fault as it was stated as nearly new, however it was 9 years old...

And then its kind of your fault for not asking how old it actually was :p Or for anymore detailed pictures.

Try and complain again I guess? It's pathetic sometimes, it really is

EDIT: Just read your above post...I can see why your slightely miffed when it could be someones life at stake :p

or is the item described as nearly new?

if its the former, nothing much you can do, unless its in really bad state - scratched etc...

if its the latter id be peeved as well.

but ive never seen an article described as being Nearly new, however i have seen the condition stated as 'nearly new'
