PCN Query

Anybody know what the guidance is on PCN having to provide proof of the offence?

We have a large fleet of vans and one of our vehicles which was driven by a temporary member of staff (now left the company) received a PCN (Council issued) which we've just received. We requested photographic proof and they came back saying the photo was too dark to show anything but got the warden to phone the office and verbally state the offence.

Any ideas?

So what evidence do they have then? Its still the responsibility of the driver to pay for the fine regardless if hes still at the company, just give then his details.

Surely no evidence = no offence? Otherwise any traffic warden could just pick cars at random and make up offences to get their stats up?
