got my new system setup (finally after 9 hours)

checked temps and all are ok, 8800 gtx is running at 57 idle and around 65 under load.

installed Double Agent (came with the card) and it looks like this

wtf? is this because theres no decent drivers or is it borked?

Double agent is buggy as hell on the PC and has some major issues with the 8800 series, which hopefully will be fixed with the next patch or driver update. Check out ubisoft.com to find some serious unhappy campers.

looks like there are more problems with the 8 series than i first thought.

This is a problem with ubisoft releasing broken games, not a problem with 8 series cards.
