porting an existing number over to a new sim

Would this render the previous sim (with the same number innactive)?
We have somebody refusing to hand over a phone with its sim and so do not want to have to pursue a small claims issue. There is no problem in getting the phone back, it's just that they refuse to hand over the sim (phone number), claiming its their property when it is not because it belongs to the Company.
 
Get the phone back, let them keep the SIM, de-activate the account through your business account portal and then proceed to laugh manically as their number dissappears into thin air.

Unfortunately, the dimwit sold it, which is why I hastily added a sub claus in the compromise agreement to get rid of her, holding her responsible for any costs involved in its replacement. Suffice it to say she sold property that did not rightly belong to her.
