Possible bad mobo

Hi there. Im thinking an rma might be in order for a motherboard I've bought from OCuk.

Its a gigbayte MA770T-UD3. The first lot of problems are constant cold boot issues. If the pc is cold, it wont boot properly. It will only boot after several hits of the restart button

PSU bad your thinking? replaced the psu with a new ocz 500w psu. The memory? heres the wierd bit. The 2 sticks of xms3 ddr3 will show errors in memtest in slots 1 and 2 in the mobo, but not in 3 and 4. Also, the sticks are fine on their own, but together in slots 1 and 2, they give errors.

The cpu is a brand new phenom 2 965 be 125w and the c3 revision, and is running great. The only conclusion i can come to is its a dud motherboard. It was an a grade board so maybe the faults it was sent back for werent found.

should I rma it?
 
yes i have, 9 9 9 9 24 at 1.65v. tried slowing thm down too and undervolting, tried everything. ocuk website says 8 8 8 8 24, ive used these too.
