Possible faulty memory controller for the motherboard?

A while ago I have bought a i5 750, 2x4GB vram and a Gigabyte P55-UD5 as a bundle from MM. The motherboard was sold by the seller stating it has a known fault of sound not working, so he has provided a Asus Xonar DG along with the board so it is not an issue.

I finally got all the exact parts together and managed to build it today, but on boot, I am greeted with long contant beep. So I taken the standard steps of testing using only 1 stick at a time, using the two 4GB sticks, as well as one 4GB stick pulled from a working system, and they all beeps in the same way as following:

For the 4 memory slots from left to right (1 stick at a time):
1st and 3rd: Constant fast rapid beep (the same as the warning when memory not properly sitted or no memory installed)
2nd and 4th: Long constant beep

Both seem to be warning relating to the memory, so a I right to think just the sound of the motherboard is buggered, but the memory controller of the motherboard as well?
 
could be the board doesn't like 4gb sticks?

havnt tested p55 with 4gb,only 2gb modules
Can't really see it would be such a case, as I would think the OP have had this pairing of ram with this motherboard before (when it was still working).

I might need to start considering the possibility of contacting the seller for a refund. The money it's not a lot for the board itself, but it's gonna be a pain to find an appropriate P55 board at low price to replace it...as well as taking things apart and to build again. Been quite busy lately so don't really have much time...
