pot hole claim refused

hi all, hoping someone on here might have a solution to my problem. Hit a pothole on roadside which was about 10m long and hidden under water. It was a good 6 inches deep. damaged my rims on there nearside so had them fixed and supplied before and after pics to council along with relevant photos of the road and measurements etc.
They countered with something along the lines of : a thorough check of that road was made just 6 months back via a drive by and revealed no work necessary - furthermore as its at the edge of the metalled surface of the road they are not required to fix it (as stated in their policies and practices etc etc)
I replied stating the inspection was inadequate since the date they suggested was during heavy rains and no one would be able to tell the depth or width with so much water on the road. I also queried why further up the road the edges of the road HAVE been filled in with tarmac , if they are not required to do so.
They have pretty much stuck to their argument throughout despite me trying to press them with more and more letters.
Anyone know a way to get them to change their view ? (interestingly they came out and threw some gravel in the long rut but said they'd done this merely as a precaution. That gravel has now worn away again. As I've also pointed out the grass and kerbstones are a good foot back from the damaged area so imho this should've been done surely?
I am tempted to take them to small claims court but would appreciate a good argument so I'm not accused of over reacting.
 
10m is a big gouge. As Feek said, can you post the pics?

As for the issue, before filing with the SCC, it might be prudent to send them a Notice Before Action letter. This is basically a "this is your last chance before court proceedings" warning. With it you need to include all relevant evidence and it's also advised to send specifics of the legal argument you're intending to use.

On the 2 occasions I've sent NBAs (to private firms however) they've caved and paid out.
 
Curbs are about four inches. If a pothole is six inches deep, the bottom of the car would probably be scraping along the road and imagine the damage coming out of it at any kind of speed.

I think there’s some serious exaggeration going on here.
 
Quite often see “potholes” up here at the edge between the actual road and the verge so technically not part of the road surface that are like that (and deeper than 6” in places).

Filled with water they’re a menace if you don’t know the road and pretty sure you would be on your own if you went into them.
 
Another 1st post looking for motering issue advice, shouldnt we start charging them lol
We have an active motors section that rates high in the google search results, it's not surprising we get a lot of people signing up for the forums, just for this section. I think that's great :)
