Prang Fault

Ok,

So I am going through the process of getting my old motor repaired after some chap drove into the side of me. After the initial rubbish of him not getting in contact with his insurance company for 2.5 months, he has now finally contacted them to say it wasn't his fault (when he said to me it was).

So I now have the joy of explaining what happened. So, here is my effort in diagrams...

Is this good enough to prove that it was hist fault?

That is going to be hard to prove as the damage to each vehicle would look similar if you were driving over the line and hit him. It will probably go 50/50 if neither of you have witnesses.
 
Yeah, no witness apart from the Mrs in the car with me at the time. The only pics I have are of the damage, not the cars in their locations as I wouldn't have been able to get our of the car being that his motor was implanted in the side of it.

Haha, now I have that song going through my head :D

Black box was another car, but they didn't witness the prang nor hang around after.
 
Do you know where this guy lives? Phone him up and tell him what a bad human being he is and that karma will get him. If he still doesn't care smash all his car windows in the dead of night ( a few months later) and have the pleasure that revenge brings. Just don't get caught.
 
Yep, I know where he lives... just round the corner from me. I walk past his motor most days when taking the dog for a walk.

If the insurance company does come back saying 50:50, is there anything that I can do? Can I contest that? The size of the dent in my car is pretty obvious that it was driven into. It also popped the skirting off and bent his wing, something that I don't believe would have happened by me cutting the corner and chopping the front of his car off.
 
Have you gone through your insurance yet? just tell them about it and tell them to contact the other company and sort it out.
Or has this happened already?
 
Yeah, of course I have contacted the insurance company. I went through the whole motions of him admitting fault at the scene of the prang, and then his insurance company not being able to get hold of him for 2.5 months for him to turn around and say its not his fault. At that stage my claim got rejected by the 3rd party claims company of my insurance company that deal with "admitted fault" claims, and they handed it back to my insurance company where I am now having to go through the process of them determining who is at fault.

I foresee me getting screwed over on this :(
 
I'm guessing he says you cut across the white line and he stayed in lane and had nowhere to go. It will be hard proving otherwise.
 
1) crash car
2) start smart phone recording
3) hide smartphone (or at least try not to make it obvious you are recording) and speak to the other person to get them to agree on what happens
4) walk round both vehicles video everything and car positions (make a show of it so they know if they later lie they will have to explain why the video show something different)

I think its common practise now for the person at fault to deny everything....
 
Did you get hit on the side of the car or the front corner? Side would lend more weight to it being his fault, though as said he could just argue that you were on the wrong side of the road and that's a tougher argument for you then.
 
Without any impartial witnesses and no proof of where each car was on the road, it's basically your word against his and a likely outcome of a 50/50 settlement. As frustrating it may be, let the insurance companies slug it out and move on with your life. :(
