Problems with EAX 2.0 and Call of Duty 2

Got an Asus Essence ST running on Windows 7 and when I enable EAX 2 (which as far as I know this card supports) I get kind a very annoying audio issue- for example when a grenade explodes I hear the same sound repeat for a few seconds and top of what's going on.

This is isse vanishes when running Miles.

Dolby virtual is disabled and the setting is set to to HiFi.
 
im guessing this is related to the removal of certain audio rendering capabilites that where present in xp, i know yours is not a creative branded card but have you tried alchemy? it restores eax functions by using openal or somesuch... ?
