Proving domain was open market

A guy I know had what I thought was a cool domain registered that I really liked. I said we should do a site based on it as it would be a really clever gimmick. He'd only registered it as it was a misspelling and he thought he might pick up traffic from it.

He has now let the registration lapse and it's in the open market. For some reason other domains he'd registered to try and pick up the same way he altered the email address so reminders of their impending lapsing came my way, in the end I got fed up of telling him to change it back and stopped forwarding them.

Anyway, this domain wasn't one of them, he must have had them on another address, but what I want to do is show that they were open for anyone to buy and that I didn't just transfer them over to myself and basically nick them off him.

Ones a .com and the the other a .co.uk. Is there any records of ownership history on these things so I can show he let it expire and I, like anyone could have, simply bought it?

If it's on the open market, just buy it on the market, from a reputable domain-selling site. They won't sell it to you if it's not available.
