Putting in a claim

I had a nasty fall coming out of college today down some wet stairs and dislocated my shoulder. :( The stairs were on the college premesis coming out from one of the buildings. It has been raining on and off all week so they were wet. I was walking down with my mate, slipped half way down and landed on my arse at the bottom dislocating my shoulder in the process.

There was a sercurity guard right behind me when i fell and he came running over making sure i was ok and the rest. He phoned for an ambulence and then called his mate over. They both said that there has been a history of people falling down these stairs and nothing has ever been done. The health and safety team at college had proposed to put some none slip stuff on the stairs but they had never got round to it.

The shoulder in question has came out before, originally christmas 2004 while playing football. I have been to see a few specialists and am currently waiting on a list for an operation.

I managed to successfully jar it back into the socket and the sercurity guards took me inside where it was warm to wait for the ambulence. The ambulence came as did the health and safety guy from the college and took all the usual stuff. Name, DOB, any allergies. The paramedic checked me over and made sure it was in ok and told me there was no need to be taken in just to strap it up, painkillers and rest. The health and safety man took my course and course leader info and said he would report it to them.

The sercurity guards told me to definately put a claim in as it is a known problem that has never been rectified. He said i should have no problems as the college will have some sort of cover and i have witnesses including one of the security blokes.

Do you lot think i have a claim? Does anyone know if any of these claims companies are actually ok to deal with? Any help is appreciated!

Yea i think you should, people have claimed for a lot less lol and this is actually something decent to claim about
 
I would probably do so, depending on the influence this will have on your lifestyle in the coming months. If it was fixed and now needs an operation, then I would be inclined to file a claim. This is of course based on the college knowing about the problem and doing nothing to prevent it.
 
Definately put a claim in. The college should've at least put signs up for a wet floor. Did your friend witness the security guards saying they knew about the problem?
 
Someone in the office isn't doing their job.

I'm suprised that was allowed to be continually used in its state as you described. Go in and throw a bucket of water over the place, take a photo of it then scarper.

That will help as evidence ;)
 
Yeah my friend witnessed the guy saying it and in actualy fact one of the security blokes i met later said he had actually fell himself and that the report had been magicly lost or something and never been put through to be taken any further.

The thing is i now cant drive for about a week because its sore and i dont want to risk it coming out whilst going round a corner! From past experience im going to have a few sleepless nights because of the pain and have to do everything with my left hand now which is going to be hard because im right handed and thats the bad shoulder :(

Im also going to struggle to play my Wii on christmas day now!! Dissaster!

Visit to the doctors in order then on to a claims firm. Make sure you get details for the claims firm of the doctors visit.
 
When i go to the docs what do i ask for some painkillers and proof ive been? Im already going through a process to get an op so i can't he can't refer me..

Sounds incredibly negligent of the college. TBH, I wouldn't put a claim in if I wasn't actually losing money ie. you being out of work as a result of your shoulder, but in this case I think you should just to make a point so this doesn't happen to someone else - maybe worse.
 
Think im definately going to put a claim in. Worst thing that can happen is they put something on the stairs to stop people slipping which is obviously not a bad thing! I wont have to pay any legal cost either because im a student. Result!

Going to the docs tommorrow for some pain killers and going to get a note to say i've been to see him. My stepdad is getting me a number for a solicitor that he's heard of thats done a lot of claims before.

Does anyone know how long these things normally take and what they involve?

Well the college is negligent. Not only is that a safety issue but due to the fact that others have fallen and hurt themself in some way clearly shows not only failure to carry out procedure of doing their duty of abiding by their agreement of keeping you safe which in this case would technically still fall under the health and safety at work act 1974. So I would put in a claim yeah, you have proof, suggest you get in contact with that security guard or anyone else who has hurt themself.

Putting a claim in won't just benefit you though, it would benefit the college as well, if a claim does go in they have to act on that and fix those stairs in an appropriate way. So your doing the right thing, your preventing future accidents as well.

Tbh, not too long imo but it all depends, its a simple enough case and if you have sufficient evidence i.e your injuries maybe an x-ray or records from the doctors and even proof of others slipping maybe even a few photos of the steps which clearly show its a hazard.

Also explain about your injury how you have injured it before and its not good for this to happen again, how you are unable to drive safely, how your unable to do other things you do. Try and get hold of records of complaints being put in about those steps too. Security guard as a witness or a written signed statement would be a massive help to your case.

Most claims like personal injury claims usually don't end up in law suits though.

Also its up to you if you hire an attorney but if its a simple process that you find out you gotta do then just do it yourself.

I did yeah. When i first dislocated it in 2004 i was off work for 6weeks over the christmas period. The weekend i done it LOTR Battle for middle earth came out on the pc and i completed all with my left hand lol. Took me most of the 6 weeks but i did it!

What are you claiming for? It had been raining, steps were wet, you slipped.

No one's fault.

You want your college to wipe your bum for you? Are you going to sue them if you get a smelly bum if they don't clean it up?

No, the college was aware in the first place as he stated, and there were previous complaints on it, but no action was taken. Meaning he has good cause to put a claim in end of story.
