Hi overclockers,

My wife works in a small wedding shop and just have a few questions.

Her contract says she works 4 days a week, but in december the owner is shutting shop for a month so my wife wont get paid as she wont be working. Is this right?, all the owner has said is, if you want to get some money for that period book those days as holidays.

She is also on a mission to save money atm and despite the contract i mentioned before she wants to cut all the staffs hours by half. Can she do that even tho there is a contract in place for 4 days a week currently?.

Im sorry if this sounds like stupid stuff to be asking but any infomation will help.

No, she can't do that but this may not stop her from trying to. I'd be more concerned about the long term prospects of your wife's employment rather than just the 4 weeks. It sounds like financially the owner is in a mess.

My wife has just mentioned the boss said the reason to cut hours is because if staff are working under 22 hours a week she wont have to pay national insurance and tax. (How crappy)

Assuming she is over the financial thresholds she should be paying tax and NI! If her employer hasn't been paying her NI it can affect her pension eligibility!

The owner is currently paying her NI but it's one of the reasons the owner wants to cut hours to 16 a week, (which is pathetic) is so she wouldn't need to pay in future.

I'd suggest your wife takes her contract down to the local CAB on one of her days off. They would be best placed to advise, as it doesn't sound right at all.

Oh, and there is one t in cut (sorry but repeated typos make my brain melt)

Hopefully the CAB could advise? I don't really know employment law too well. TBH, she should be looking about for something else, as it seems her position has become quite precarious and the shop could go bust any day now by the sounds of it :(
