Question for those who have been executors

Hi folks,

Just fishing for a bit of reliable info, whilst I’m also off Googling for more.

Both myself and my sister are currently listed as ‘executors’ to my Dad’s estate, I believe the term still applies anyway, as he had no will.

Long story short, we have been through probate and got that and my Dad’s death certificate has gone off to those who need it, and everything (bar his employer) is going well.

Now, last month I got a letter through – I say ‘letter’ it seemed more like a junk mail mail-shot, and was advertising a company who specialise in probate; bit like an accident management company, but for death. But the first page of the booklet was actually a letter addressed to the executor, and went on to state about £1,400 was owed to “Post Office”, and that we should contact them – I tried several times but could never get through.

Got another letter from them today stating that their client would be happy to accept about £1,000, immediately followed by “(SAVING the Estate £….)”, call me cynical, but that just seems like an attempt to make you think “oooh I’ve got a great deal” and not at all the sort of wording I’d expect to see on a letter going out to a grieving family; though as my company always remind us – business not charity…

I’ve googled the company (Phillips & Cohen Associates) and I’m working through the results to see if the company is legit, but I can’t help but shake off the feeling that they’re just trying it on – maybe hoping that with everything else we have going on and all other bills coming in, we’d happily pay this off without question….

Don’t get me wrong, I will happily settle anything we are legally obliged to, but I lived with my Dad and he often talked about bills and finances, and where had was going etc to pay them, but never once did he mention “Post Office”, nor did he go into a post office to pay bills.

So I guess my question to the good folk of OcUK is – has anyone else experienced this sort of thing, and if so, what did you do?

Thanks.

Phillips & Cohen Associates seem to eb a comapny with a Uk office who haven't even built their Uk website first, and have only one single office here and 5 offices in the US and one in Canada.

The Post Office would not use such a company for 'debt' recovery from an estate.

They are going thru the list of dead in local papers and sending out tosh no doubt.

Report them to the FSA for unsolicisted mail, sure to be nothing to do with the FSA, but the query might wind them up anyway.

Don't lawyers usually sort all this stuff out? I understand they cost money but it might be easier to let them sort it all out for you?

I wouldn't repond to it in all honesty. Place a deceased estate notice in the London Gazette and let people come out of the woodwork.

As executor named on the Grant of Probate (Is it only you named) you are charged with settling the estate, but part of that charge is to act with due care.

Seeing as you already have the GOP, you've done the hard part. I've worked for one of the UK's leading probate providers for almost 2 years, and am more than happy for you to mail me any questions - no charge of course :)

Thanks for the replies peeps :-)

We were given free legal advice as part of my Dad’s pension plan, and as his estate isn’t vast in any way, a lawyer would simply be overkill.

Thanks for the info, and the offer, that’s really nice of you :) I think I’ll wait and see if they send anything else, I put the ‘Notice Pursuant’ advert in for tomorrow’s local paper, and I understand we have to give that two months for anyone to put their claim in. Both I and my sister are on the GOP though, she’s dealt with it mostly, but because I live at Dad’s address I’m getting the mail – so far this company are the only ones to have sent such a claim.

Thread disappoints. :(

Was hoping for tales of beheading and electrocution...

Hahahaha, I did a little ‘lol’ to that :D
