Quick continuous play question

My PS3 broke (laser problem) anyhoo it was picked up 2 days ago and I got a brand new replacement
Is this mine now or will my old one be fixed and sent back? It was never clear

Sweet I only got it a few months back on ebay and it stunk of fags. A nice new clean one suits me
