He's been caught doing 52 in a 30, he's just got a letter through the post saying he's got to attend court.

He's had his licence for more than 2 years now and is clean. What are the possible outcomes?

Thanks
Steve

My neighbour was caught doing 60 in a 30, outside a school for good measure and was given 5 points and £400 fine.

I'd say 6 points and a fine, doubt he'll be offered the Driver Improvement thing if that's what he's hoping for.

He's not hoping for that just not the big fine, he's properly skint, if he can't pay what happens then?

edit: it also had no mention of date, i take it this will be sent through separately? How long does it usually take does it all depend which court he attends and how busy it is or something?

Is this definitely a court summons, or is it a "Notice of Intended Prosecution"? Normally you'd have to be going 26 over for it to end up in court, but even then you will still get an NIP first. Also a court summons will definitely have a court date on it.

Based on my assumption that what you have is an NIP asking you to identify the driver, if he admits to being the driver he will next receive a "Conditional Offer of Fixed Penalty" which is the standard 3 points £60 thing that keeps it out of court.

If your friend has already received an NIP and sent it back, and this is actually a court summons then disregard this post.

Just like to add that if he does get a COFP out of this, bloody well take it. The magistrates can fine up up to 6 points and £1000 plus costs, plus the £15 victims of crime surcharge. For 52 in a 30 they'll have a field day since your friend is obviously a child killer (in their eyes) and there are no 2 lane dual carriageways with completely inappropriate 30 limits in Bristol. (I bet that's where he got done)
