quick question regarding legal aspect of website

If people pay to advertise on a website and supply an image to use, if this isnt their image in the first place is this copyright infrigement of the website owner for putting it up (assuming the site owner doesnt know if its the persons image or not) or would this be a legal matter for the person wanting to USE the image?.

If the website owner is aware the image belongs to someone else they shouldn't put it on their website. I'm not a copyright expert but otherwise I can't see how it could be the website owner's fault if they were taking the image in good faith. To protect themselves the website owner could create a small set of terms & conditions with one being that the copyright of the supplied artwork mustn't be owned by anyone other than the company or person supplying the artwork (unless they've paid/have permission to use it for that purpose).
