Hi guys

just having an arguement with someone about the responsiblilty of passengers in a car

now i know if you're over 14 you can be fined for not wearing a seatbelt but what about being a passenger in a car which you know is unroadworthy, take for example:

car has MOT, tax, insurance etc etc so is all legal BUT, the headlights are borked so the full beams are always on (i presume this is illegal) and the indicators are broken

my friend thinks that me as a passenger is liable to be fined for riding in the car because i "should know better"

is this true?

i agree with him that the car is very dangerous but luckily the MOT runs out next week, but i cant imagine i could get fined too

As far as im aware its totally the drivers responsibility.

exactly as i thought :) can anyone else confirm?

its like me driving round with a bald tyre and my passenger getting 3 points as well as me  - just seems daft

Totally the drivers responsibility in my experience. Ive been in a couple of cars which have been pulled for bald tyres and headlights out etc. The rozzers didnt even speak to me or the other passengers.

Been in a car with a drunk driver too, again we didnt even get spoken to. The driver was simply taken off in the police car after the police were happy the vehicle was parked in a safe place and locked up, and we were told to make our own arrangements and left.
