Radeon 390 - Is HDCP "on" for none protected content?

Is HDCP "enabled" for desktop sharing/cloning none protected content or is HDCP only "on" when using protected content?

I ask as I am wanting to use an HDMI scaler but it only supports upto HDCP 1.3.
