Recycle bin acting odd

When i open up recycle bin and press the "Empty Recycle Bin" it doesnt and instead will open up my documents in an explorer type window with the tree structure down the side.
i have to empty the bin by right clicking it on the desktop.
any ideas what is going on and how to fix this?

i noticed this ages ago, i just hadnt got round to asking about it. so system restore is out of the question really!
