Registering domains

Are there any problems registering a domain that a competitor with a a local chain of shops has clearly missed?

Loads of people do it but was just wondering what the legalities of it were if any?

There is no legal reason stopping you from buying a domain. however if the company have a legal trademark with that company name then have a legal entitlement to have the domain if they wish to do so.

also if i'm not mistaken if you are not using it can be requested off you

That's true, but very hard to prove as you may just use the email facilities, which is a legitimate domain use.

What zeegy says is true too. So if you buy it in the hope that one day they go, "oh, we need that domain, heres £50K", you're in for a bit of a let down. They would much rather just use their trademark to have the domain legitimately moved for their use.

And got away with it for years
