Renting... Moving out before first 12mths is up...

Hello,

So me and the gf moved into a flat last July, however over xmas decided to get a house to save the expense of renting. We've had our offer accepted and are about to start proceedings...

I suspect that our contact has a 12mth minimum clause in it somewhere although will check later, but wondered...

If we wanted to move out before our 12mths is up, can we? At what cost? Will we lose our deposit or something? We can give easily 4 weeks notice, so is that all they need?

Anyone have experience of this

Depends what is stated in your contract.

A friend of mine for example has to pay rent till someone else takes up tenancy (or the contract ends).

Who are you renting with? We rent with Elms Price Maston and they have a 6 month break clause.

What you will look at to pay is the advertising fees (will be a percentage of the monthly rent), and then any rent where the property is empty. There shouldn't be any issue with it. How much time do you have left on your contact?

Till Mid July 2010.

We could try and delay the mortgage completion but would rather just get it done as soon as possible, if we can....
 
Talk to your landlord/agent ASAP. Even if your contract commits you to 12 months the last thing most landlords want is a tenant who doesn't want to be there. I had a similar situation once where I needed to move out a couple of months early, despite my contract saying otherwise the landlord said that it was ok provided they could find someone else in time.
 
The larger rental companies tend to give little leeway in allowing you to leave earlier. Probably have to pay for advertising as well as rental until property is occupied again.

The best thing is to contact them asap and get an agreement in writing about any pontential costs you will incur.
 
I've just phoned my landlord, he's fine with it, I just need to give 2 months written notice.

So that should be plenty of time.
 
You really, really need to learn to read and understand your contract(s) before signing them. In fact something as important as this should be asked about and agreed on before the contract is even created! :)

I think it's a standard contract, there wasn't much customisation. I'm sure it does say it somewhere, and may well have agreed on it as couldn't see any reason why 12mths wouldn't be a problem. As it turns out it's standard for our letting agent to offer 6mth exit clauses providing 2 months written notice is given.

So happy days, case closed :D
 
I moved out of my flat and into my nan's empty house to help out keep it secure etc.

I either had to pay the remaining term of my contract in one go or pay it off as normal month by month.

Never helping family again!
 
in our contract we get a 6 month break clause which is in march, which basically means that if things aren't working out then we can cancel the tenancy in march, however if we are happy where we are we can keep on renting for another 6 months ect....

ask your LA about this and as everyone saids read the terms and conditions VERY IMPORTANT that you do. do not sign the tenancy agreement . any changes that you want to make to the property make sure you get official authorisation from the LA in writing before making changes. :)
