Returning goods not as described

Bought a airsoft gun back on 18th of August from a online retailer. Didn't work as described so it was sent back to be looked at for what was causing the issue on the 9th of September after a few phone calls to arrange the return of it.

Upto now i've still not heard anything back about if they've solved it yet but checked on the website and it says "Tested & No Work Required" so might be receiving the same gun back with faults still. By me sending it back for been faulty basically within the first 30days would i still be covered by the consumer rights?
 
Yes. As you've declared your intent in the time period, the retailer cannot 'run down the clock' and attempt to scam you out of your rights.
 
since you had had a conversation, and, presumably explained too, what was wrong,
ring them before they start sending it back, and ask how they have addressed that,
if they've genuinely done nothing, and you won't be happy with it then ask them to refund.
 
Had a phonecall off them today saying there is nothing wrong with the gun and they want to return it. Just wondering what to do now....

The airsoft gun should shoot 38bbs a second basically and its been measured twice by me using different equipment at about 11bbs so not performing right at all.

Them as a shop are saying they are unable to measure it.....yet I can and I am not a airsoft shop lol
 
I'd present your evidence to them, give them 48 hours to confirm the return and refund. If they don't play ball then dependant on how you paid contact you credit card, bank or Paypal.

Also write down a chronology of everything that has happened. Emails, phone calls etc.
