Returning something under DSR?

I bought a NAS from what I would say is OcUK's main competitor but it didn't meet expectations. The NAS in question came in an unsealed box but it was definitely new and I don't believe it would have been sealed in the first place.

I have however tried the item out and even updated the firmware before I realised it's not for me. in total i used it for a couple of hours.

I have contacted the competitor and said I would like to return it under DSR (only had it for a couple of days). They have sent me a RMA number and a date to return it by.

What concerns me is this competitor as got a poor track record of RMA's so I'm wondering if they will accept or even be able to tell the item as been used and if sending it back under DSR does it matter anyway?

I updated the firmware as at the time I didn't realise it wasn't for me and I wanted to start off using the latest firmware.

Where do I stand? should I just return it as is (am I within my rights) or should I just sell it and take a loss?

Aren't you slightly jumping the gun here and worrying about a problem that may not even occur? So far it sound like the firm has followed the correct procedures so why not see if they manage to complete the process without issue? I'd suggest getting proof of postage or whatever they demand to show that you've complied with their RMA process though. Indeed you could, I suppose, ask them if updating the firmware is an issue they would be concerned about - don't give your RMA number if you don't want to link the transactions and just ask it as a general question.

Updating the firmware may be an issue given you wouldn't normally get to do that in the shop but it equally may not be an issue at all.
