Returning unwanted online order

I just purchase a couple of move controllers online,arrived today. I might not need them after all,now I've opened the box to make sure they were not damaged. Contacted the retailer to see if it's possible to return them & they said no,because I've opened them.

I though if you bought online you had 14 days & were allowed to physically examine the goods under DSR

Any ideas folks ?

Reading that link, it says in the paragraph on returning goods, that handling of goods delivered after ordering online or by phone is the same as would be allowed in a shop, presumably you would have the box opened to check the stuff in a shop.
On a similar subject, I ordered some underwear for my wife’s Christmas gift, online from Agent Provocateur, 2 thongs, £100.
She saw the confirmation email, as it came in on her phone, as well as my iPad, and said that she didn’t like my choice, but would take a look when they arrived.
She opened the package and said thanks Jean, but no thanks, I put them back in the box and returned them, 21 days later my Debit Card was credited with the £100.
I gave her the dough, and she got what she wanted at Victoria’s Secret, apparently G strings are now her thing, I got a volley for not noticing, I must be slipping.
 
when you say you opened he box do you mean the box it arrived in or the packaging the item comes in ie the sealed box or blister pack


If you’re referring to the Agent Provocateur lingerie that I posted about, we opened the box and the packaging inside.
The packaging contained the two aforementioned thongs, she eased open the sellotape holding the paper bag shut, looked inside, then carefully replaced the sellotape, without removing the items of clothing.
I put it all back together, fixed the supplied address sticker to the original box, over my address, and took it to the Post Office.
There was no charge for returning it.
 
Does CCR apply to underwear?

I thought don't retailers accept returns due to hygiene reasons

I guess that you mixed up your words there, but it’s obvious what you meant.
When I returned the lingerie that I bought for my wife, it was patently obvious that it was in pristine condition, gently unwrapped but not not removed from packaging, and in an unworn state, otherwise I doubt that they’d have reimbursed me in full.

The retailer is at it, you can return anything within 14 days. The retailer could make a deduction to refund if the goods have had packaging damaged etc.. but in my experience the refund is normally no quibble and in full.

Nice try String, but no cigar, I can post a selfie of myself looking vaguely bemused while looking
in my wife’s knicker drawer, but I’m guessing that you’re kinky enough to say “yes please.”

I opened the actual box the controllers were in,it was just sealed with a sticker,no blister pack. The retailer told me that I'd agreed to the t&c before I purchased, so not possible to return, because I'd opened the packaging

This isn't true. Are you still within your 14 days? Did you pay by credit card?
 
I used PayPal

Contact the retailer once more and tell them you are entitled to a return for refund under consumer law because you bought online. Tell them that you'll be forced to raise a case with PayPal if they don't organise an RMA.

If they refuse, let PayPal sort it for you.
 
Do people really think it is routine in bricks and mortar shops to demand the shop open packaging before purchase?
