rma able?

hi all

i have an old 9800gt im running in my current system till i can upgrade
its not bad, still gets decent frame rates in modern fps's even @ medium detail

but

if i leave fan on auto it stays at 35% no matter what temp it gets to
if i manualy set the fan, as soon as temp reaches 70 degrees c
the card will switch fan speed back to auto, which means dropping fan back to 35% resulting in artiafcts then eventualy the card shutting down

from reasearch ive done it apreas to be some sort of bios error
lucky me its still in warranty with pny.. but is this mater rma'able?

also anyone know number for ringing about rma's with PNY?

ive tried a few numbers from googling but none worked thanks again in advance
