Ok, so here is the story.
In Mid-March I bought a Corsair Performance 3 64GB, and built it into my system about 3 weeks later. Life was good for a short period of time... Near the end of July the drive suddenly died on me. Now as this was more than 28 days after purchase, and I was already going through a hellish RMA process with Amazon, I followed the advice on the OCUK website.
As such I set up an RMA with Corsair, which they promptly dealt with and I received a Force 3 60GB as a replacement as they had stopped producing the Performance 3 64GB. I received the good in late July. In the inter-period, whilst waiting for the RMA to go through, I purchased a WD Green which I used as a boot drive, and had absolutely 0 problems (this was approximately 4 weeks of reasonable use). Upon receiving the Force 3 I promptly installed it all and got everything running. I did however start to notice the occasional lock ups - so well known as issues with the Sandforce drives. I ran with this for a while, without caring too much as the lockups weren't frequent enough to bother me, and I think in the whole time since I have had only one BSOD which did say harddrive error.
Today however, I finally got fed up, as in the last few days alone I must have had about 6/7 lock ups, with 3 today, and 2 within 10 minutes of each other...
As such I thought I should probably look up firmware, and it turned out it is running 1.2. Now the latest version on the Corsair support forum is 1.3. However reading around on the Corsair forums, the about half of the first page of their 'SSD Firmware update forum' is issues where people have updated to 1.3 and are still having issues. Now frankly (and I think understandably) I don't want to go through the hassle of updating to 1.3 and still experience these problems...
Over the past couple of weeks I have run memtest/P95/Tried different systems/hardware etc... and am 99% sure that it is the SSD that is at fault.
Now I'm going off to Uni in a couple of weeks, and therefore don't really have the time to faff around too much...
Frankly, as well, because of the issues with the SSD I'm having and the widely reported issues (including a complete recall of the 120GB models by Corsair), with this I'd quite like to return the product and get a full refund, and be able to order something like the M4.
My other issue is that frankly, I don't think a company could reproduce the issues easily. I expect they do a thorough test process, but the lock-ups are completely random and as such they could get 50 examples of the problem in a day, or they could get 0, and I don't want to be forking out the cost of shipping + testing costs etc... Whilst I have worked out that it is the SSD I have basically done this by elimination changing all other elements and keeping the SSD...
My questions therefore are:
Where do I stand on this?
What would be the best way to go about obtaining this? (Bearing in mind I don't have all the time in the world to faff about).
Would the fact that I RMA'd directly to Corsair already have any effect? (negative or positive)

Direct Manufacturer Technical Support. Although Overclockers UK is happy to provide support after 28 days many manufacturers or their appointed agents offer a direct service. This is often the best solution for the customer with the highest standards of technical support, latest information and fastest returns processing. Please see the table below marked "Over 28 Day Support".
