RMA problem. Please please help

Well i had a look at benchies and according to them 60 idle is way too much especially for an unoverclocked card. My load temp is verging on the limit. When i get ti 90+ deg c why doesnt the fan go uo more? Any reasons for this? The fan control is on auto
 
By impartial i meant he wouldnt know what was wron with the card. He has as level IT. qualified? 50% fan gives 70 deg c playing alien swarm.
 
Ok the thread is a bit longwinded but still thanks for all the help you have given me. Brief summary of current situation: card heats up too much. Send back to rma. No fault found. Sent back to me. I have the same problem. Manufacterer not replying to emails. Consumer direct says that goods are not fit for purpose and should ask again fir refund. Will wait for HIS to reply and then go to ocuk with evidence. Also am comoaring cards performance to that of an old dell 8800gtx to prove faults.
